Vibe Group Privacy Statement

In this Privacy Policy statement, we inform you of how and for which purposes Vibe Group processes your personal data. At Vibe Group, we comply with the European Union’s General Data Protection Regulation (GDPR) and other relevant privacy laws and regulations when processing your personal data.

This means that we:

  • Provide this Privacy Policy statement, in which we define and state the purposes for which we process your personal data before any such data is processed.
  • Store as little personal data as possible and only the data necessary for our purposes.
  • Explicitly ask your consent for processing your personal data, whenever consent is required.
  • Take necessary security measures to protect your personal data. We also impose these obligations on any third parties who may process your personal data on our behalf.
  • Respect your rights, such as your right to accessing, correcting or deleting your personal data that we process.

Who are we?

We are Vibe Group (referred to in this Privacy Policy as ‘Vibe Group’ and ‘we/us/our’). Vibe Group is an international IT staffing firm that connects IT professionals with employers. Our company operates under four specialist brands: Visser & Van Baars, Spilberg, Eswelt and Tergos.

As part of our services, we process personal data. For these processing operations, Vibe Group is considered a data controller, as defined by the GDPR.

When do we collect your personal data?

Vibe Group collects your data at least in the following cases:

  • You consent to our website’s cookies, which collect your personal data when you visit our web pages.
  • You contact us.
  • You register for an event organised by us.
  • You become a Vibe Group employee.
  • You respond to a job vacancy on our website or to one of our vacancies posted on another job site.
  • We find your (online) profile, deem you to be suitable and possibly interested in our services or a position within Vibe Group, and contact you directly to offer our services to you.
  • We deem you, as a potential client or employee of a potential client, to be interested in our services and contact you directly to offer our services to you.
  • You are a contact person for one of our clients.

You are a candidate using our services to search for a job or assignment for yourself. 

For which purposes do we process your personal data?

We collect various types of personal data from you for different purposes. For each purpose, we indicate which data we obtain from you, for what purpose we process it, and for how long we keep it. If your personal data is processed for any purpose not stated in this Privacy Policy statement, we will inform you of this in a timely manner and via an appropriate channel (for example through our internal Privacy Policy statement when you join Vibe Group as an employee, candidate or client). Maintaining business relationships

Vibe Group processes personal data in order to properly maintain business relationships. For this purpose, we process the following personal data from the contact persons of our business relations:

  • Name, job title and employer
  • (Work) telephone number and email address
  • Any content of, or notes on, the correspondence between you and us

Vibe Group retains this personal data for as long as the business relationship exists. The legal basis for processing this data is our legitimate interest in maintaining our business relationships.

Services to clients

Vibe Group processes personal data of our clients (and their employees) to enable us to provide our services and to provide potential customers with offers and information about our services. Vibe Group processes the following personal data for this purpose:

  • Name, job title and employer
  • (Work) telephone number and email address
  • Any content of, or notes on, the correspondence between you and us
  • Any other personal data that the client (and/or their employees) provide to us within the context of the service we provide to them

Vibe Group retains this personal data for one year, starting from the date we last used the personal data for the described purpose, or for as long as necessary to fulfil our legal obligations. The legal basis for processing this data is our legitimate interest in being able to provide our services.

Services to candidates

Vibe Group processes personal data to find suitable candidates so that we can meet our clients' requirements. For this purpose, Vibe Group uses the personal data that the candidate sends to us (for example, when applying for a job through our website) or personal data posted publicly (including on the internet) by the candidate.

We use the candidate’s personal data in the context of providing services to inform them about our services, to determine their suitability for vacancies or assignments, to send them potentially interesting job updates , to introduce them, with their consent, to clients they are interested in, to carry out pre-employment screenings (or have them carried out), and to approach them for events that may be of interest to them.

For these purposes, Vibe Group processes the following personal data of (potential) candidates:

  • Name, job title, employer
  • Telephone number and email address
  • Curriculum Vitae (CV), education, diplomas and certificates, skills, work experience, references, place of residence, presence of driving licence, language skills and other personal data necessary for assessing the suitability of candidates
  • The candidate's wishes and preferences regarding the job or assignment they are seeking, such as (but not limited to) willingness to travel, salary wishes, work-from-home option and sector preference
  • Any content of, or notes on, the correspondence between you and us
  • Nationality
  • Background-check information when necessary
  • Any other data provided by the candidate in the context of the services we provide

Vibe Group retains this personal data for one year, starting from the date we last used the data for the purpose described, or for as long as necessary to fulfil our legal obligations.

The legal basis for identifying suitable candidates is our legitimate interest in meeting our clients' requirements. The legal basis for introducing candidates to potential employers/assignments is the consent the candidate grants for us to do this.

Applying for a job at Vibe Group

If you apply for a vacancy to become an employee of Vibe Group, Vibe Group processes your personal data to facilitate the application process. Part of this is assessing your suitability, possibly through screenings and/or assessments. For this purpose, Vibe Group processes the following personal data of its applicants:

  • Name, job title and employer
  • Telephone number and email address
  • Curriculum Vitae (CV), education, diplomas and certificates, skills, work experience, references, place of residence, presence of driving licence, language skills and other personal data necessary for assessing the suitability of job applicants
  • Any content of, or notes on, the correspondence between you and us
  • Nationality
  • Background-check information when necessary
  • Results of assessments where applicable
  • Other data provided by the candidate in the context of the job application process

Vibe Group retains the personal data for this purpose for four weeks, starting from the completion of the application process, or, with the candidate’s consent, for one year, starting from the completion of the application process.

The legal basis for processing personal data during the application process is our need to assess the potential formation of an employment contract between the applicant and Vibe Group. The basis for assessing and possibly screening candidates is our legitimate interest in recruiting and evaluating prospective employees for suitability. 

Placement of independent professionals

When you work as a self-employed professional through us at one of our clients, Vibe Group processes the personal data listed below in order to facilitate the performance of the agreement you have entered into with Vibe Group. In addition, Vibe Group may process your name and recorded working hours for the purpose of internal management reporting. The personal data that Vibe Group may process in order to enable your agreement as a self-employed professional with Vibe Group are:

  • Name, job title and client
  • Telephone number and email address
  • Postal address
  • Financial and bank information
  • Recorded working hours
  • Insurance certificate
  • Place and date of birth
  • Any content of, or notes on, the correspondence between you and us
  • Nationality
  • Document number, document type, country and date of issue and period of validity of your identity document
  • Picture of proof of identity and a photograph of you for the purpose of identity verification prior to the assignment
  • Background-check information where necessary
  • Copy of highest diploma obtained
  • Other information provided by you in the context of the services we provide.

Vibe Group retains this personal data for up to two years after the end of the assignment, or for as long as necessary to fulfil our legal obligations. The data used for identification purposes when entering into the agreement (specifically the photo you take of yourself and the photo of your identity document) is retained for 30 days after the completion of the verification process. 

The legal basis for this processing is the necessity of the processing for the performance of the agreement we have entered into with you as a self-employed professional. The legal basis for processing your data for management reporting is our legitimate interest in providing Vibe Group’s management with the information needed to manage the organisation effectively.

When you visit our website, we place cookies in your browser. More information about these cookies, the data they collect and how long they are stored can be found in the cookie banner and in our Cookie Policy.

Cookies that collect personal data are only placed with your consent.

Contact and complaint handling

When you contact Vibe Group via a contact form on our website, by emailing us directly or by contacting one of our offices by telephone, we process your personal data in order to handle your inquiry or complaint. To provide you with the best possible service, we may process your:

  • Name, job title and employer
  • Postal address, telephone number and email address
  • The nature of the inquiry
  • Any content of, or notes on, the correspondence between you and us

We retain this data for as long as necessary to handle your inquiry or complaint. Data that is no longer required for this purpose will be deleted no later than one year after receipt.

The legal basis of this processing is our legitimate interest in handling inquiries and complaints appropriately, or, where applicable, the necessity of the processing for the performance or initiation of a contract to which you are a party.

Dealing with requests from data subjects

When you contact us to exercise your rights as a data subject, we process your personal data to ensure the proper handling of your request, to maintain our records of such requests and to demonstrate our compliance. For this purpose, we process the following personal data:

  • Your name
  • Telephone number and email address
  • Nature of the request
  • Any content of, or notes on, the correspondence between you and us

We retain this data for five years after your request has been handled. The legal basis for this processing is our legal obligation to respond to data subject requests.

reCAPTCHA

We use the reCAPTCHA service provided by Google Inc. (Google) to protect our website against spam and abuse. To enable reCAPTCHA, the IP address of the website visitor, mouse movements and possibly other data are collected. This information is transmitted to and processed by Google. By analysing this data, Google can determine whether a real person or an automated system (bot) is visiting the website. For more information, please refer to Google’s privacy statement.

Social media buttons

When do we share your personal data with third parties?

Vibe Group shares your data with clients and, where applicable, with screening agencies as part of recruitment services, but only if you have indicated that you wish to be proposed to a client for a specific assignment or role.

Personal data may also be shared with clients via the client portal when you are placed with a client as a self-employed professional through Vibe Group.

Personal data may be shared with third parties when we are legally required to do so, for example by law or court order.

Personal data may also be shared among the legal entities that are part of Vibe Group.

The parties that process personal data on our behalf, or on your behalf, within the Netherlands, within the European Economic Area (EEA), or in some cases outside of it, include:

  • IT service providers, such as companies that host or maintain our website
  • Software vendors, for example, providers of customer or service management systems
  • Marketing companies, for example, to conduct market research
  • Customer service providers, such as reception or telephone support services

International transfers of personal data

Vibe Group may transfer your personal data to organisations outside the European Union. If the country in which the recipient organisation is based has not been granted an adequacy decision by the European Commission, we will use Standard Contractual Clauses (SCCs) to ensure an appropriate level of data protection.

When we transfer your personal data to parties outside the EEA based on SCCs, you have the following rights:

  • To request information about the transfer, including a copy of the SCCs
  • To contact both us and the receiving party for further information
  • To file complaints with the receiving party, the Dutch Data Protection Authority, a competent court within the EEA, or an independent dispute resolution body
  • To claim compensation if the SCCs are breached

These rights are in addition to your general privacy rights under the GDPR.

Our database is hosted in the United Kingdom. The United Kingdom has been designated through an adequacy decision by the European Commission as providing an adequate level of data protection.

Personal data security

Vibe Group is committed to protecting your personal data against loss, unauthorised access and alteration. To this end, we use measures such as multi-factor authentication and role-based access control (RBAC). Vibe Group employees are bound by a confidentiality agreement. 

Data subject rights

When Vibe Group processes your personal data, you have the following rights:

  • The right to access your personal data
  • The right to have your personal data rectified if our information about you is incorrect or outdated
  • The right have your personal data erased
  • The right to restrict our processing of your personal data
  • The right to object to the processing of your personal data
  • The right to have your personal data transferred to another party (data portability)

Vibe Group does not engage in exclusively automated decision-making.
